These Terms of Service ("Terms") govern your access to and use of the website located at gobblegobble.com (the "Website"), operated by Greenberg Smoked Turkey Inc., a company incorporated and located in Tyler, Texas ("we," "us," or "our"). By accessing or using the Website, including creating an account, browsing products, or making a purchase, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website.
1. Eligibility
You must be at least 18 years old to use the Website or make purchases. By using the Website, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We reserve the right to refuse service, terminate accounts, cancel orders, or bar customers from future ordering at our sole discretion.
2. User Accounts
To make purchases on the Website, you must create an account using a unique email address. We do not use traditional passwords for account access. Instead, authentication is handled via one-time passcodes (OTP) sent to your registered email address or, if you provide a mobile number, via text message through Twilio. You are responsible for maintaining the security of your email and mobile device, as well as for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
We do not store your credit card information. Payments are processed through Stripe, a third-party payment processor. We may store a secure token provided by Stripe to facilitate future charges or refunds for the card you use. You may request to delete this token at any time by contacting us, or you can manage it through your account settings where available.
3. Products and Purchases
We sell fully cooked whole smoked turkeys available for pickup at our location in Tyler, Texas, or for shipping directly to addresses within the United States only. All product descriptions, images, and prices on the Website are subject to change without notice. We make every effort to display accurate information, but we do not warrant that product descriptions or other content are error-free.
When you place an order, you agree to pay the listed price plus any applicable shipping fees or other charges. No taxes are charged on purchases. Orders are not binding until we accept them, which we may do by confirming the order via email or by shipping the product. We reserve the right to cancel any order for any reason, including pricing errors or suspected fraud. However, we will not cancel an order solely due to a product being out of stock. In such cases, we will attempt to ship a product of greater value, if available, at no additional cost to you. If no larger product is available, we may ship a smaller product and refund the difference in price.
4. Payment Processing
All payments are handled securely through Stripe. By providing payment information, you authorize us (via Stripe) to charge your payment method for the total amount of your order. You represent and warrant that you are authorized to use the payment method provided.
5. Shipping and Delivery
We ship products only within the United States using FedEx or UPS. Shipping times and methods are estimates and not guaranteed. All arrival dates are approximate. We ship packages appropriately to arrive on or around the preferred arrival date you request, but we may ship items early at our discretion. We guarantee that shipments will arrive in good condition if delivered to the accurate address you provide. Title and risk of loss pass to you upon delivery to the shipping carrier for shipped orders or upon pickup for local orders.
You may provide an email address or phone number for the recipient during the order process. If provided, we will notify the recipient about the incoming shipment via email, text message, or sometimes mail. This Notice of Shipment will include the order number, delivery address, and estimated arrival date.
If your turkey does not arrive in good condition, is not delivered, or there are other delivery issues attributable to us or the carrier, please contact us promptly for assistance. We are not responsible for delays or issues caused by incorrect addresses, weather, natural events, carrier errors beyond our control, or other unforeseen circumstances.
6. Refunds and Returns
We offer refunds or replacements in certain situations, such as if the turkey arrives in poor condition, non-delivery, or other issues covered under our guarantee. To request a refund or replacement, contact us within a reasonable time after the issue occurs, providing details. In some rare cases, we may request evidence (e.g., photos of the product) to process your request. Refunds, if approved, will be processed through the original payment method or via Stripe. We may, at our discretion, offer a replacement shipment instead of a refund.
We do not offer refunds or replacements for subjective reasons, such as the turkey being too smoky or not meeting personal taste preferences. All sales are otherwise final, and we do not accept returns for change of mind or other non-guaranteed reasons. For pickup orders, inspect your product at the time of pickup; issues must be reported immediately. We do not accept exchanges for pickup orders once the turkey has left the building due to USDA regulations.
7. Intellectual Property
We own all content on the Website, including text, images, logos, product descriptions, and other materials ("Content"). The Content is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from the Content without our prior written consent. Use of the Website does not grant you any ownership rights in the Content.

9. Disclaimer of Warranties
The Website and all products are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or products, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the product in question.
11. Dispute Resolution
Any disputes related to purchases will be handled through the credit card processor (Stripe) where applicable. For other disputes arising from these Terms or your use of the Website, you agree to first attempt informal resolution by contacting us. If unresolved, disputes shall be governed by the laws of the State of Texas, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Smith County, Texas.
